Terms and Conditions

Terms & Conditions to Participants in M&Ms Back toSchool 2025 (the ‘Campaign’). These Terms and Conditions(T&Cs) govern yourparticipation in M&Ms Back to School 2025 and constitute an agreementbetween yourself (the ‘Participant’) and Francis Busuttil and Sons (Marketing)Limited (‘FBSM’).

A. The Back to School Competition

 

Participants may enter the M&M’sBack to School Competition (the “Campaign”), organized by FBSM, by purchasing any 2 bags from the list ofeligible products below and by following the participation steps outlined inSection C. Participation of thisdocument. Entry into the Campaign is subject to full acceptance of these Terms& Conditions.

Eligible Products (must display the FBSM address on theback of the packaging):

  • Maltesers     Bag 175g
  • M&M’s     Chocolate Bag 250g
  • M&M’s     Salted Caramel Bag 200g

 

B. Duration of Campaign

 

The campaign shall commence on the 15th September2025 and shall end on the 20th October 2025 (the ‘CompetitionPeriod’, both dates included. FBSM reserves the right to cancel, shorten,extend, terminate and/or suspend the Campaign Period or otherwise modify orcancel the campaign at its discretion and at any time.

C. Participation

 

In order to participate in the Competition, one needs tofollow the following steps:

 

1.    Purchase any M&M’s orMaltesers product mentioned in Section A. The Back to School Competition.

 

2.    On the Malta M&M’s Official FanPage (https://www.facebook.com/mmsmalta) find the competition post related tocompetition.

 

3.   To take part inthe Campaign, Participants must complete the competition task as follows: underthe related competition post on the Malta M&M’s Official Fan Page(Facebook), post a photo showcasing their Back-to-School setuptogether with 2 purchased packs of participating M&M’s or Maltesersproducts.

The photo should reflect creativity and originality inpresenting the Back-to-School theme and in the overall photo execution.

The prize will be awarded to one (1) Participant, inthe form of a voucher for the designated prize, whose entry is selected as thebest during the competition period. The winning entry will be chosen at the endof the competition period by a panel of three (3) FBSM employees.

The winners will be contacted via Facebook. FBSM will askthe winners to provide contact information to be able to communicate with themto pick up the prize. FBSM reserves the right to select another winner shouldthe first winner/s not reply to the Facebook private message withintwenty-four(24) hours. 

Result will be made official on the Malta M&M’s OfficialFan Page Facebook page within a week of the end of the competition.

 

By taking part in this Competition, the participanttactically accepts these T&Cs.

 

All receipts given when buying the M&M’s and/orMaltesers products are to be kept by the participants. The winners of theCompetition prizes shall be requested to submit the receipt. Failing to do somay result in forfeit of the competition prizes.

D. The Campaign Prizes

 

The prize of the Competition are listed below(‘Prize/s’):

 

·  A voucher for the Apple MacBook Air 13.6"Retina (M4 Chip, 10-Core CPU / 8-Core GPU, 256GB SSD, 16GB RAM, Sky Blue).

 

1.  The winning photo will be published on the FBSMSocial platforms.

2.  The winner/s will be asked to provide proof ofidentification before the prize may be collected, and the Competition Prizewinners shall be presented with the respective prize upon presentation of avalid identification document.

3.  The Competition Prizes cannot be exchanged for anyother offer.

4.  FBSM shall not be liable for or be obliged toreplace any lost or stolen Competition Prizes.

 

E. Privacy

 

Your personal data processed for the purposes of this Competition shall be processed in accordance with the data protection policy available here

F. Modifications and Termination of the Campaign

 

1. FBSM reserves the right to modify any of theT&Cs set forth herein.

2. A Participant’s participation in the Competitionconstitutes the Participant’s acceptance to these T&Cs as may be amendedfrom time to time. Participants are responsible for keeping up to date with anychanges that FBSM may make to these T&Cs. The most current version of theT&Cs will be made available on the Malta M&M’s Official Fan PageFacebook page and will supersede all previous versions of these T&Cs.

3. For the avoidance of doubt, any cancellation,revision, termination, or suspension by FBSM of the Competition shall notentitle any Participant to any claim or compensation from FBSM for any and allloss or damage suffered or incurred by any Participant as a direct or indirectresult of the act of cancellation, revision, termination or suspension.

 

G. Miscellaneous

 

1.    FBSM reserves the right todiscontinue the participation privileges of any Participant who engages in anyimproper activity or uses the Competition in a manner inconsistent with theseT&Cs or any national law. In addition to termination of participationprivileges, FBSM shall have the right to take appropriate administrative and/orlegal action, including criminal prosecution, as it deems necessary in its solediscretion.

2.    FBSM’s decision on all mattersrelating to the Competition will be final and binding.

3.    FBSM and its respective relatedcompanies, parents, subsidiaries, affiliates, and respective agents and theiragencies, suppliers and other companies involved in the development orexecution of the Competition, or the production or distribution of Competitionmaterials shall not be held responsible or liable in the event of a printingerror or irregular packaging. In such cases we encourage you to file acomplaint on  info@fbsmarketing.com.

4.    To the fullest extent permittedbylaw, by participating in this Competition, each and every Participant isagreeing that he/she will not hold FBSM  and its officers, servants,employees, representatives and/or agents (including without limitation, anythird party service providers that FBSM may engage for the purposes of thisCompetition),liable for any loss or damages that he/she may incur, inconnection with the Competition.

5.    Prizes in this competition areoffered at the discretion of FBSM and Ultimate and the companies reserves theright to modify the terms and conditions of participation or any other aspectof competition at any time, with reasonable notice being given to the datasubjects, even though such changes may affect the prize value. Participantswill understand that the most recent version of the terms will be updated onFacebook page or any other portal. Any participant may object to themodification of the competition and /or its terms by deleting the posted photoand no longer participating.

 

 

H. Limitation on Liability and Warranties.

 

FBSM will not be responsible or liable for any injury, loss,claim, damage or any special, exemplary, punitive, indirect, incidental, orconsequential damages of any kind (including without limitation lost profits orlost savings), whether based in contract, tort, strict liability, or otherwisethat arises out of or is in any way connected with:

·   The Competition

·   Any failure or delay by FBSM with theCompetition

·   The performance or non-performance of theCompetition by FBSM even if the latter has been advised of the possibility ofdamages.

This disclaimer of liability applies to any damages orinjury caused by any failure of performance, error, omission, interruption,deletion, defect, delay in operation or transmission, computer virus,communication line failure, theft or destruction or unauthorized access to,alteration of, or use of your registration information, whether for breach ofcontract, tortuous behaviour, negligence, or under any other cause of action.If, despite the limitation above FBSM is found liable for any loss or damage whicharises out of, or is in any way connected with, any of the occurrences describedin the limitation above, then its liability will in no event exceed, in total,the sum of fifty Euros (€50).  

FBSM makes no warranty of any kind regarding the Competitionwhich is provided on and “as-is” and “as-available” basis. FBSM expresslydisclaims any representation or warranty that its Competition will beerrorfree.

FBSM expressly disclaims all warranties and conditionsincluding implied warranties and conditions of merchantability, fitness for aparticular purpose, title, non-infringement and those arising by statute orotherwise in law or from a course of dealing or usage or trade.

 

I. Taxes.

 

Determination and payment of tax liability on awards,including income tax, if any, are the sole responsibility of the winner.

 

J. Acts Beyond Francis Busuttil &Sons(Marketing)Limited Control.

 

The failure of FBSM to comply with these T&Cs because ofan act of God, war, fire, riot, terrorism, earthquake, actions of federal,state, provincial or local governmental authorities, or for any other reasonbeyond the reasonable control of FBSM, shall not be deemed a breach of theT&Cs. If any such contingency shall last for more than sixty(60) days, FBSMshall have the right to terminate the Competition immediately by giving noticeand shall have no further liability to any Participant.

 

K. Governing Law.

 

The laws of Malta, without regard to its conflict of lawsprinciples, will govern these T&C’s, as well as the Participants and FBSM’sobservance of them. If you take any legal action relating to your use of thiscompetition or these T&C’s, you agree to file such action only before thecourts located in Malta.

 

L. No Waiver.

FBSM’s failure to exercise or enforce any right or provisionof these T&Cs shall not constitute a waiver of such right or provisionunless acknowledged and agreed to by FBSM in writing.

 

 

M. Captions.

The headings in these T&Cs are for your convenience andreference only. These headings do not limit or affect these T&Cs.

 

N. Complete Agreement.

These T&Cs, together with those items made a part ofthese T&Cs by reference, make up the entire agreement between FBSM andParticipants relating to the Competition, replaces and supersedes any priorunderstandings or agreements (whether oral or written) regarding theCompetition. If a court finds any of these T&Cs to be unenforceable orinvalid, those term(s) will be enforced to the fullest extent permitted byapplicable law and the other T&Cs will remain in full force and effect.
